27 Holdouts In Stones Case As VerStandig “Withdraws” As Counsel

In the latest filing related to the California lawsuit against Stones Gambling Hall and Justin Kuraitis, stemming from “Postlegate”, attorney Maurice “Mac” VerStandig officially submitted a “Notice Of Motion To Withdraw As Counsel” for the remaining 27 Plaintiffs who, to date, have not signed the settlement agreement between the parties.

Listed as reasons for withdrawing, VerStandig notes an “overwhelming majority” of Plaintiffs signed off on the settlement. Secondly, he explains “various attributes of the agreement” would potentially create a conflict of interest between counsel and remaining Plaintiffs.

“Third, there are also reasons counsel of record would be potentially unable to pursue certain claims herein without violating the rules governing practice before this Honorable Court including, inter alia, Federal Rule of Civil Procedure 11. These reasons were never manifest prior to the filing of any adversarial papers in this case.”

In addition, “several – but not all – of the non-Settling Plaintiffs” have quit communicating, “none of the Plaintiffs have compensated undersigned counsel”, while also noting they are not required to do so.

VerStandig also explains many of the remaining Plaintiffs have instead decided to just let their claim(s) lapse.

“Many of the non-Settling Plaintiffs – but not all – have affirmatively indicated an intent to pursue this matter no further and permit the lapsing of their claims by virtue of the passage of time…”

The list does not include Kasey Mills, who was also not on the list of settling Plaintiffs in another recently filed court document, suggesting she may have since joined the settlement.

Other notable “hold outs” are Veronica Brill, who headed the accusations, Jake Rosenstiel, and Azaan Nagra, who Rosenstiel explains was the first to suspect Postle was cheating (full article on rounderlife.com).

Poker Pro and Solve For Why team member Christian Soto is also on the list of Plaintiffs not signing off. Soto played in the last session Postle played on September 21, 2019 and lost $9,050, but only $175 of that was to Postle.

Another “pro”, Marc Goone, who reportedly lost over $10k in the streams, including large pots to Postle when he (Postle) turned a straight in one hand and Goone missed a flush draw in another, told David Tuchman in an interview in an “Under The Gun” podcast on October 12, 2019 that he viewed the lawsuit as a “free roll“.

Goone added that he was certain Postle was cheating explaining “I’ve played maybe 4,000 hours of poker in last three years” and had never seen a “40 year old middle aged white guy” making the moves Postle made.
