Marle Cordeiro’s Case Against Mike Postle Dismissed

On Friday, August 14, 2020 United States District Judge James C. Mahan dismissed a lawsuit filed in Nevada District Court by Marle Cordeiro against poker pro Mike Postle.

In the six page ‘ORDER’ Judge Mahan disagreed with counsel for the Plaintiff, Maurice “Mac” VerStandig’s argument that Nevada was the proper jurisdiction for the case.

VerStandig had argued, “Importantly, Ms. Cordeiro was swindled in Nevada. While she ultimately partook in a rigged poker game in California, it was the Defendant’s fraudulent conduct in prior cheated games – broadcast to Ms. Cordeiro in Nevada – that constituted the core of the dupe herein. .”

In response the court explained, “This argument fails to consider that the defendant was a participant of the broadcast games—not the broadcaster—thus, defendant did not “expressly aim” his alleged poker misconduct at the state of Nevada.”

Plaintiff’s request for jurisdictional discovery, partly based on Postle’s monthly trips to Reno for parental custody exchanges, were also denied.

The court noted, “However, plaintiff’s complaint only alleges that defendant “habitually” travels to Nevada, “often for extended periods of time.” The absence of the other allegations in the complaint weighs against the propriety of jurisdictional discovery. Further, this single allegation is not sufficient for the court to allow jurisdictional discovery because defendant denies habitually travelling to Nevada for extended periods of time.”

VerStandig issued the following statement in an article published on PokerNews in regards to the ruling:

“The US District Court for the District of Nevada found Mr. Postle lacks sufficient contacts with the State of Nevada to be sued there, and accordingly dismissed the case. I have immense respect for the court as well as the judge who issued the ruling; it is well-written and well-reasoned. Importantly, however, the order does not speak to the merits of the case. Mr. Postle has now amassed a laudable track record of avoiding substantive legal inquiries into the sum and substance of his actions; it seems supremely unfortunate he has taken this path and not, instead, seized on one of these opportunities to clear his good name. Ms. Cordeiro and I are still reviewing the order and assessing various options.”

VerStandig noted the court did not speak to the “merits of the case”, when it threw it out.
